This Roundtable presentation will address the following topics:

  • LIBOR continues to die. Recent developments include the occurrence of the Spread Adjustment Fixing Date and resulting creation of Synthetic LIBOR, the requirement by bank regulators that no new LIBOR-based obligations be originated after December 31, 2021, and a continued search by some players for an alternative to SOFR.
  • CCPA class actions, and the closely related doctrine of Article III standing, are rapidly evolving, as courts continue to refine the jurisprudence in this space in response to legislative initiatives and plaintiffs’ bar innovations.
