On January 5, 2024, the Supreme Court of the United States granted certiorari in three cases:
Trump v. Anderson, No. 23-719: This case addresses the Colorado Supreme Court’s December ruling that barred Donald Trump from the state’s presidential primary ballot under Section 3 of the 14th Amendment. The Supreme Court scheduled the case for oral argument on February 8 to consider whether the Colorado court erred in its determination.
Moyle v. United States; Idaho v. United States, Nos. 23-726, 23-727: These consolidated cases challenge a district court’s preliminary injunction that paused the implementation of an Idaho state law criminalizing most abortions. In addition to granting certiorari on the cases, the Court reinstated Idaho’s law, pending the resolution of the cases. The issue presented is: Whether Idaho’s Defense of Life Act, which prohibits abortions unless necessary to save the life of the mother, is preempted by the federal Emergency Medical Treatment and Labor Act.
