Oklahoma v. Victor Manuel Castro-Huerta, No. 21-429: This case presents the following question: Whether a State has authority to prosecute non-Indians who commit crimes against Indians in “Indian country.” Notably, the Supreme Court declined to grant certiorari on the second issue presented in this case of whether to overrule McGirt v. Oklahoma, 140 S. Ct. 2452 (2020), in which the Court held that much of eastern Oklahoma is a reservation for the purpose of a federal statute that gives the federal government exclusive jurisdiction to prosecute certain major crimes committed by “any Indian” in “Indian country.”
