There has been significant recent focus on racial equity and how to address systemic inequities in our justice system. In the context of the courtroom, these issues are of critical importance, and there are specific rules that apply to lawyers to try to mitigate discriminatory outcomes. This session will provide an overview of the key ethics rules that apply to lawyers when it comes to race in the courts, including the American Bar Association Model Rules of Professional Conduct, the Minnesota Rules of Professional Conduct, the Minnesota Human Rights Act, and the Minnesota Court Rules. The panel will then relate those rules to several hypothetical scenarios and explore possible reactions or responses that might better serve the parties and our system as we work together to navigate these tough issues and improve access to justice.
