Since Prop 65 became law in California in 1986, it has gained a reputation nationwide as an unusual state statute that triggers liability for consumer product distributors across the country. With its draconian penalties and unusual warning requirements, the law has been a costly snare for many unwary food and beverage distributors. Recent regulatory changes and judicial rulings have significantly altered the Prop 65 landscape.
