Overview

Evan counsels clients on complex construction projects.

Evan is an experienced advocate and advisor representing clients in the construction industry. Evan litigates construction defect, delay, and contract disputes in federal and state court and in arbitration proceedings. He also regularly counsels clients on construction contract drafting and negotiation, licensing requirements, government contracting, performance and payment bond claims, and insurance issues. Evan has worked with clients throughout the construction industry, including private and public owners, general contractors, subcontractors, and design professionals.

Representative Work

  • Represented Denver Regional Transportation District in defending $100+ million claim brought by private partner regarding responsibility for delays and costs in large-scale commuter-rail project, resulting in total defense verdict. Prepared witnesses for trial, drafted pretrial motions, and led large-scale document review and discovery effort to prepare for trial. Drafted brief on appeal and opposition to petition for certiorari to the state Supreme Court, resulting in affirmance of judgment.
  • Litigated complex insurance coverage matter, involving dispute between primary and excess insurers, through trial and appeal, resulting in favorable settlement.
  • Represented hospital owner in four-week arbitration hearing over a multi-million dollar construction dispute.  
  • Represented homeowner pro bono in state-court trial, obtaining judgment for return of funds for unperformed work. Defended judgment on appeal, resulting in affirmance.  
  • Won arbitration award following one-week hearing in favor of general contractor client in multi-million dollar construction dispute.
