Overview

The discovery process in modern litigation can produce an amazing number of records– Email messages, word processing files, spreadsheets, legal agreements, audio and video files, presentations, memos, etc.- as an ever greater number of computer users leave an endlessly expanding trail of electronic records that are often kept indefinitely.

The attorneys on our Electronic Discovery team help clients identify, collect and produce relevant electronic and other information in response to a request for production in a lawsuit or an investigation. Our experience in managing electronic discovery ranges from smaller matters involving less than one gigabyte (50,000 pages or less) of data to complex matters that often involve terabytes (millions of pages) of data.

We also offer our clients powerful tools to review huge piles of documents efficiently, thoroughly and accurately, enabling them to effectively manage costs.

Our attorneys are uniquely qualified to help clients effectively manage the timelines associated with the retention of documents. We have helped hundreds of firms, ranging from small businesses to Fortune 500 companies, adopt and manage records management policies, ensuring that only required business and compliance records are retained for the appropriate time period and that extraneous materials are discarded in a timely manner. We help clients appropriately identify and delete unneeded materials because, when taken out of context and viewed through a cynical lens, many seemingly innocuous items can be effectively manipulated by opposing council in adversarial proceedings.

We also help clients develop litigation readiness and legal hold plans to ensure that they are properly prepared to respond to e-discovery requests and our lawyers are adept at ensuring that document requests by opposing council are limited to producing only data that is likely to be relevant, and not broad fishing expeditions.

When the need arises, we work closely with the members of Dorsey's LegalMine team to ensure that our clients have access to state-of-the-art technologies and accurate and cost-effective document review services.
