Ten years ago the U.S. Supreme Court’s Leegin decision overruled the longstanding Dr. Miles rule that had considered resale price maintenance (RPM) agreements to be per se violations of the federal antitrust laws. Not all of the states have accepted the Leegin decision in interpreting their own state antitrust statutes.

Michael Lindsay has just published the latest in a series of updates on state RPM law, in Contact Lenses and Contact Sports: An Update on State RPM Laws. In addition to the article itself, Dorsey associates Erik Ruda, Katherine Arnold, David Green, Emily Mawer, and Jeremy Schlosser assisted with updating the State Resale Price Maintenance chart describing the state RPM law in each of the 50 states. The Antitrust Source has described this chart as “One of Antitrust Source’s most utilized resources.”
