Overview
Elliot has represented clients in all phases of complex litigation in federal and state courts as well as mediations and domestic and international arbitrations involving breach of contract, breach of fiduciary duty, fraud, corporate governance issues, board election disputes, construction disputes, residential and commercial real property disputes (including landlord-tenant litigation, access agreements, and judicial licenses to access neighboring property), civil rights issues, defamation, employment agreement disputes (including non-compete and non-solicitation disputes), and EB-5 litigation. He has also represented clients before administrative agencies and New York City community boards.
Elliot also has significant general counsel and litigation experience involving cooperatives, condominiums, and homeowners’ associations.
In 2021, Elliot was nominated for participation in the New York City Bar Association’s Fifth Annual Associate Leadership Institute, an ABA award-winning program geared to provide high-level career advancement and leadership training for mid-level and senior associates from New York City’s most prestigious law firms.
During law school, Elliot held an externship in the Real Estate Finance Bureau of the Office of the New York Attorney General, which is charged with enforcing Article 23-A of the General Business Law and governing regulations that regulate the offer and sale of real estate securities.

Representative Experience
- Secured dismissal of claims brought against the board of managers (the “Board”) of a commercial condominium building in NYC’s Times Square Theater District commenced by four non-owner mortgage lenders who sought a declaratory judgment determining borrowers’/retail unit owners’ obligations under the condo governing documents to pay common charges for Local Law 11 façade work (a/k/a FISP) and purported damages associated with the same. The Court largely adopted our arguments on behalf of the Board that the four plaintiffs lacked standing under the condo governing documents to dispute the Board’s allocation of FISP-related common charges because they were not unit owners when they commenced their lawsuit and that the one plaintiff’s acquisition of the unit after the litigation was commenced but prior to the Court’s determination on our motion to dismiss did not retroactively cure plaintiffs’ lack of standing.
- Part of team that successfully defeated a motion for a preliminary injunction at evidentiary hearing in U.S. District Court, Eastern District of New York brought against a provider of technology for hazardous gas detection to enjoin that provider from selling, buying, renting, reselling, or distributing certain products in certain territory or developing and/or distributing software relating to gas detection products.
- Successfully opposed a motion seeking to dismiss electrical construction and solar contractor’s breach of contract, fraud, tortious interference with contract, and unjust enrichment claims regarding contractor’s provision of materials and work which involved complex, multi-state personal jurisdiction issues.
