"Most litigators are familiar with subpoenas. Not as many are accustomed to civil investigative demands. But litigators, particularly federal practitioners in government enforcement, must understand them because government agencies are relying on them now more than ever. To wit: the U.S. Department of Justice recently announced that it issued a record number of civil investigative demands in FY 2023. This article addresses civil investigative demands to note their important similarities and differences with subpoenas, and to provide attorneys representing recipients with tips to respond."
