On February 29, 2024, Partner Joe Lynyak was interviewed on Bloomberg Law Podcast by host June Grasso to discuss the Supreme Court arguments over exempting national banks from state law. The case at hand is "Bank of America v. Cantero," which looks at a law that hasn’t changed since the Civil War regarding the National Bank Act.
“In the Cantero oral arguments, the Court expressed significant concern both regarding the meaning of the terms ‘prevents,’ ‘significantly interferes’ contained in Section 25b of the National Bank Act as well as the role courts in general would be forced to play on a go-forward basis,” explained Joe. "The Justices seemed very uncomfortable with the role of explaining what 'standard' is under the statute.”
