The Star Tribune reports that Dorsey client Mayo Clinic and the University of Minnesota have filed suit in U.S. District Court seeking restitution of approximately $2.8 million in Social Security payments. The tax was imposed by a 2005 U.S. Treasury Department regulation requiring Social Security payments for any medical resident whose normal work schedule consisted of 40 hours or more per week.
According to Dorsey counsel John W. Windhorst, Jr., one of the Dorsey attorneys litigating the case, the 2005 regulations were issued after several federal courts had ruled that medical residents at Mayo Clinic and the University of Minnesota did not have to pay Social Security taxes.
