The threat of terrorism, the transfer of functions from the former INS into the Department of Homeland Security, and the U.S. economic slump have combined to impact the ability of employers to hire and retain highly qualified foreign workers.  The quality of immigration services and benefits has deteriorated - processing times have increased, background checks are routine, border inspections have been intensified, and thousands of individuals are subject to "special registration."  At the same time, it has become ever more important for employers to hire top employees, whether U.S. workers or foreign nationals, to have the best chance to succeed in the current economic climate.
