Overview

BECKI ASSISTS CLIENTS IN THE AREAS OF LITIGATION AND ADMINISTRATIVE LAW WITH AN EMPHASIS IN HEALTH LAW.

Becki is always ready to present the strongest case for each client, and yet also finds it important to explore solutions that make sense, even if that does not include filing a lawsuit. Becki regularly assists health care providers, including nursing homes and continuing care communities, pharmacies and pharmacists, doctors, dentists, nurses, veterinarians and other professionals, with professional licensing board matters, regulatory citations and regulatory compliance. These matters often involve negotiating with government agencies, including the applicable licensing boards, the Department of Inspections and Appeals, the Department of Human Services and the Centers for Medicaid and Medicare Services (CMS), among others. Becki also handles a significant number of judicial review proceedings arising out of healthcare regulatory matters, including, but not limited to Certificate of Need decisions.

Becki assists providers with commercial or payment disputes with insurers, including managed care organizations, contractors and patients. She has significant experience in assisting nursing facilities with collection efforts, including assessing options for resident Medicaid coverage, pursuing involuntary discharges and filing lawsuits to collect past due amounts. Becki has handled non-compete and non-solicitation litigation for all types of businesses, including requests for injunctive relief. Becki also has experience in litigating commercial and contract disputes for all types of businesses.

In addition, Becki has experience in medical staff peer review and credentialing procedures, including developing or improving hearing processes. She also has experience in government procurement or request for proposal matters, including both challenging and defending government awards.

In addition to her health law-related experience, Becki has experience in regulatory and litigation matters for the agriculture sector. She has handled professional licensing board disputes for veterinarians as well as administrative hearings involving the Iowa Department of Agriculture and Land Stewardship (IDALS) and the Iowa Department of Natural Resources (DNR).

Becki has taken numerous cases to trial or administrative hearing, and has significant experience in appellate briefing and oral arguments. She has assisted numerous nursing home clients with the Informal Dispute Resolution (IDR) procedures available to them during the state and federal citation process. She can help lead clients through receipt of a subpoena to an appeal and everything in between, as well as helping healthcare and other businesses assess their policies and practices to help reduce their litigation risks.
