The week of June 22 was the most active week in initial public offerings since May 2008, signaling that perhaps the IPO drought is almost over. What does this mean for companies? This recent IPO activity reminds us that companies need to make sure that their house is in order to prepare for a possible IPO, acquisition activity or just to preserve competitive position in the market. Because intellectual property law is often counterintuitive and complex, quite often intellectual property mistakes occur when resources for legal advice are tight and the primary focus is on the companyʼs growth and survival. While this is often true for start-up companies it also plagues more mature companies in lean times. During such times, companies often overlook or are unaware of intellectual property issues, which can result in a reduction in valuation of the company in exit events and an increase in accounting and legal fees.
