Current Issues in Chapter 11 Bankruptcies

Members of Dorsey’s bankruptcy team will discuss several current issues related to Chapter 11 Bankruptcies:
- “Structured Dismissals” -- Whether a bankruptcy court may authorize the distribution of settlement proceeds in a manner that violates the Bankruptcy Code priority scheme (Jevic Transportation case; pending in the Supreme Court).
- Split in the circuits over the treatment of make-whole payments in bankruptcy (Energy Futures decision-3d Cir.).
- Affiliate setoffs and netting provisions.
