This presentation will provide an overview of Assignments for Benefit of Creditors ("ABC"). In particular, our panel will discuss the pros and cons of an ABC, when an ABC should be considered, who are the players in an ABC and what are their roles, and who should be chosen as the Assignee. John Murray and Steve O’Neill are experienced California bankruptcy practitioners, and will focus on California law and practice. Tom Kelly will discuss the recently adopted Minnesota ABC statute and how the Minnesota statute compares to California law and practice.
