The first session focuses on the most common mistakes made by management and human resources; the second analyzes the consequences of bizarre behavior by employees.

Management and HR Mistakes: Key management and HR personnel occasionally make mistakes that exacerbate existing employment problems or create new problems entirely. This session will explore thirteen fundamental errors (such as the Mistake of Ignorance, the Mistake of Arrogance and the Mistake of Inaction) that are made again and again, exposing companies to liability and costly adverse judgments. We will examine specific real-life situations, focusing on practical advice regarding how to avoid replicating these problems.

Employees Gone Wild: Employees, from the most junior to the CEO, occasionally act unpredictably, imprudently and bizarrely. When employees' antics make news, immediate personnel actions may be warranted and criminal prosecution may result. In certain situations, employee conduct may affect a company's stock price or even jeopardize its existence. An interdisciplinary panel examines eight real-life situations where employees' actions have created serious employment, criminal and public relations problems.

You’ll learn from the very unfortunate, but often amusing, mistakes of others in these sessions, both of which use humorous video clips and real-life examples to illustrate some of the basic mistakes made, and the strangest situations encountered, by management in today’s workplace.

A partner in Dorsey's Trial group, Steve practices in the area of commercial litigation with an emphasis on all aspects of employment litigation, including age and gender discrimination, misappropriation of trade secrets and enforcement of non-compete contracts. In addition, Steve has significant experience litigating environmental, oil and gas leases, banking, intellectual property, securities, construction and franchise matters.

Roy Ginsburg, Partner (Dorsey & Whitney LLP)
Roy Ginsburg, twice chosen for the Minnesota Attorney of The Year award (2011 & 2006) and selected by the ACC’s Lexology as “Author of the Year” in 2010, is a Partner in the Labor & Employment Law Department. Roy has focused on commercial disputes affecting the employment relationship, including, misappropriation of trade secrets, corporate raiding, usurpation of corporate opportunity, breach of fiduciary duty, breach of contract (such as post-employment restrictive covenants), and related claims. He also defends class, multi-party and individual employment discrimination litigation.
