Like old heavy metal rockers still on tour, the key internet-related laws on which we rely are really showing their age. Enacted in a pre-social network, pre-smartphone world, major coverage gaps exist. More and more often, seriously “creative” interpretation is required to make these internet stone age laws work at all. Meanwhile, over 750 million people actively use Facebook, 10 billion apps have been downloaded from Apple’s App Store, and mobile device usage is skyrocketing. Companies have rapidly adopted social networking as a communication and marketing tool and are pursuing behavioral and geolocation-based advertising. While legislative and regulatory processes trudge along, companies like Facebook, Google, Twitter, Apple, and LinkedIn are filling the Grand Canyon-sized gaps with their website terms of use, privacy policies, and business practices. This session will examine some of the gaps and how the policies and practices of internet companies might impact your business, sometimes in unexpected ways.
