Antidumping and Countervailing Duty Proceedings
- Obtained the lowest preliminary antidumping and countervailing duty rates for the Argentine mandatory respondent in White Grape Juice Concentrate from Argentina proceedings, and negotiated a suspension agreement to avoid final antidumping and countervailing duties.
- Obtained court-ordered revocation of the antidumping duty order with respect to a foreign respondent in Certain Steel Nails from the United Arab Emirates proceedings before the U.S. Court of International Trade.
- Secured successful representation of a mandatory respondent in the Diamond Sawblades from Korea antidumping investigation, including appeals before the U.S. Court of International Trade and the U.S. Court of Appeals for the Federal Circuit.
- Lowered the antidumping duty rate for a foreign exporter and mandatory respondent in the administrative review of Certain Steel Nails from Oman proceedings before the Department of Commerce.
- Represented Chinese industry associations in the Department of Commerce antidumping proceeding and ITC injury investigation in Certain Aluminum Alloy Sheet from China.
- Represented a mandatory respondent in the Department of Commerce antidumping duty investigation in Crystalline Silicon Photovoltaic Products from China and Taiwan, and represented a U.S. importer in the ITC injury determination.
- Advised U.S. importers on the anti-circumvention investigation and potential application to U.S. solar projects in Crystalline Silicon Photovoltaic Products from China (Anti-Circumvention).
- Advised a U.S. purchaser regarding Department of Commerce and ITC proceedings in Crystalline Silicon Photovoltaic Cells, Whether or Not Assembled into Modules, from China.
- Represented the respondent government before the Department of Commerce in Oil Country Tubular Goods from China proceedings.
- Represented a U.S. petitioner before the Department of Commerce and the ITC in Glycine from China proceedings.
- Represented exporters before the Department of Commerce in Frozen Warmwater Shrimp from China and Vietnam proceedings.
- Advised a U.S. purchaser regarding ITC proceedings in Diffusion-Annealed, Nickel-Plated Flat-Rolled Steel Products from Japan.
Export Controls and Economic Sanctions
- Advised clients on voluntary self-disclosures to and enforcement actions by BIS, OFAC, and DDTC.
- Drafted and assisted with implementation of corporate compliance programs relating to U.S. export controls and economic sanctions.
- Assisted clients with removal from U.S. sanctions lists administered by BIS and OFAC.
- Advised on export controls and sanctions due diligence in mergers and acquisitions, including negotiation of post-closing measures relating to trade liability.
CFIUS National Security Reviews
- Advised buyers and sellers on the necessity of mandatory and voluntary disclosures to CFIUS, including identifying U.S. operations involving critical technologies, critical infrastructure, sensitive personal data, and sensitive real estate.
- Represented both sellers and buyers in proceedings before CFIUS, including transactions involving sensitive national security technology.
U.S. Customs and Import Compliance
- Counseled clients on import entry, classification, valuation, marking, and rules of origin before CBP and disputes with CBP relating to the same.
- Advised clients on prior disclosures to CBP.
- Analyzed eligibility of imports for lower tariff rates under U.S. free trade agreements and preferential tariff programs.
Section 232 and Section 301 Tariff Matters
- Drafted comments to BIS and the Office of the U.S. Trade Representative (USTR) on proposed tariffs under Sections 232 and 301.
- Advised clients on exclusion requests to BIS and USTR.
- Reviewed harmonized tariff schedule classifications and country-of-origin determinations to assess applicability of Section 232 and Section 301 tariffs.
