Our Approach
Managing Parallel Proceedings
Today’s sophisticated plaintiffs’ bar often uses parallel proceedings in an effort to gain leverage, including federal statutory claims, derivative actions, regulatory investigations at the state and federal levels, and cross-border actions. We have extensive experience in managing these types of parallel proceedings, both within our firm and working with other firms, to ensure that actions taken in one proceeding do not negatively impact another. We are also skilled at using knowledge gained in one dispute to effectively manage risk in another. In many instances, class action litigation can result from, or spur on, potential regulatory and criminal proceedings, and our Government Enforcement & Corporate Investigations group is always ready to help our clients navigate these types of issues.
Managing Reputational Risk
We understand that, in some cases, the reputational risks that can accompany class action litigation can be more concerning than the money at stake. We are also aware that winning in the courtroom is not necessarily the only goal of our clients – we also have to prevail in the court of public opinion. We regularly partner with our clients and third-party service providers to develop comprehensive public relations and media plans.
Winning Early and Often
Our goal is always to obtain a favorable resolution of each case at the earliest possible stage. We have succeeded at winning dismissals of complaints, defeating class certification, winning summary judgment motions, prevailing at trial or on appeal, and obtaining favorable settlements. We have successfully used a number of strategies to defeat claims, including removing actions from state to federal court, defeating cases using arbitration and appraisal clauses, and developing the facts needed to deny the certification of the claims of the class representatives.
Working Efficiently and Cost Effectively
Class action litigation can produce an astonishing number of documents – email messages, word processing files, spreadsheets, legal agreements, memos – as an ever-greater number of computer users leave an endlessly expanding trail of electronic records. And improved storage capacity means those records are kept indefinitely. LegalMine™, our e-discovery service, offers our clients a powerful tool to review these huge piles of documents efficiently, thoroughly, and accurately. This is a critical in-house tool – and an advantage we have over many of our competitors – through which we help our clients effectively manage costs.
Global Reach
Through our international offices and our relationships with foreign counsel, we have the ability to prosecute and defend the interests of our clients around the globe. Our U.S. attorneys work closely with our international practitioners in Hong Kong, Shanghai, and London to ensure that our clients are represented in key international markets. The lawyers in our international offices counsel clients operating throughout Europe and Asia. We also have relationships with firms in Australia, Japan, India, Germany, France, South Korea, Taiwan, Central and South America, and the Middle East, giving us a truly global reach.
