Overview
Josh is a Partner in Dorsey’s Commercial Litigation Group. Josh has a broad practice that spans many areas of business law and civil litigation. His specialties include: (1) advising on and litigating fiduciary matters—including matters related to entity governance, director and officer duties, trusts, estates, and other professional/financial fiduciary duties; (2) drafting, revising, and litigating contracts of all sizes and kinds; and (3) advising on and litigating particularly complex civil issues—i.e., where a matter involves erudite judicial doctrine or challenging procedural questions, Josh is often called up on due to his intellectual curiosity, creative argumentation, and his ability to contextualize and simplify legal concepts.
Aside from those specialties, Josh also has significant experience advising on torts, employment disputes, appeals, regulatory issues, health care, shareholder disputes, securities, constitutional issues, trade secrets, and matters involving financial fraud.
Josh has experience advising a diverse array of clients, including executives/C-suites, high-net-worth individuals, startups, closely held LLCs and corporations, and publicly traded companies.
Since 2022, Josh has been included in the annual publication of Best Lawyers in America: Ones to Watch. Josh has also been recognized three times as a Super Lawyers Rising Star.
Apart from his commercial practice, Josh also maintains an active pro bono practice focused on representing indigent defendants in federal and state criminal cases, obtaining post-conviction relief for wrongly convicted individuals.
Josh is also actively involved in civic pursuits in which he is not practicing law. Josh serves (pro bono) as a Conciliation Court Judge in Minnesota’s Sixth Judicial District. He is on the board of directors of KFAI, a community radio station committed to amplifying voices within underserved communities, and to fostering democracy, social justice, and cross-cultural understanding. Josh is also a member of the Minnesota Board of Continuing Legal Education.

Representative Experience
- Won appeal in the Ninth Circuit reversing district court judgment in a multi-million breach of contract case concerning the use of algorithmic software to direct the trading of commodity futures contracts.
- Won appeal to Montana Supreme Court obtaining reversal of trial court decision in a construction dispute and securing an approximately one-half million-dollar recovery for the general contractor client.
- Drafted amicus Curiae brief that helped convince federal appellate court to reverse a trial court decision that threatened to shutter certain court-ordered drug and alcohol recovery programs.
- Won appeal to Montana Supreme Court resulting in dismissal of putative class action and consumer protection claims against commercial landlord.
- Represented large national bank in a dispute regarding title to approximately $250,000 of heavy equipment. Obtained orders awarding possession of all equipment at issue, and successfully defended against counterclaim for damages.
- Successfully opposed the enforcement of fraudulent estate documents by uncovering evidence of forgery that led to client receiving six-figure settlement payment.
- Won jury trial in favor of general contractor client concerning complex contract dispute.
- Won jury trial in favor of indigent defendant wrongly accused of first degree criminal sexual conduct.
- Won jury trial in favor of indigent defendant wrongly accused of the felony of fleeing police in a motor vehicle.
