Alan defends clients, from Fortune 100 companies to individuals, in complex civil disputes. 

His practice focuses on the healthcare industry. He represents clients across the industry—hospitals, providers, insurers, third-party administrators, pharmacy benefit managers, and health technology companies—in a broad range of complex litigation. 

Alan has successfully defended clients from claims of breach of contract, trade secret misappropriation, breach of fiduciary duties, professional malpractice, and claims arising under ERISA, the False Claims Act, the Mental Health Parity and Addiction Equity Act (MHPAEA), and other statutes. 

Clients value Alan’s ability to deliver results in all phases of litigation. Alan has tried a dozen cases to completion before juries, judges, and arbitrators. In other cases, he has prevailed on dispositive motions or, where appropriate, resolved disputes without the need for litigation.

Representative Litigation

Healthcare Litigation

  • Represented hospital system in breach of contract lawsuit seeking $30 million in damages; complete summary judgment and $1.7 million award on counterclaim.
  • Represented Fortune 100 health care company in multimillion dollar lawsuit brought by substance use disorder facility; obtained complete summary judgment; affirmed by California Court of Appeal.
  • Representing hospital systems and providers against claims of medical malpractice.
  • Defeated class certification in ERISA lawsuit against pharmacy benefit manager.
  • Obtained summary judgment on behalf of health insurer in class action lawsuit alleging breach of contract and violations of mental health parity laws; defeated class certification.
  • Represented hospital system in lawsuit alleging third-party indemnity claims.
  • Obtained dismissal of lawsuit against health insurer brought by out-of-network provider in lawsuit alleging ERISA claim for benefits and related state law claims.

  • Represented third party claims administrator in American Health Lawyers Association (AHLA) arbitration against provider alleging breach of contract and violations of Medicare and state insurance regulations.
  • Represented hospital system in lawsuit alleging False Claims Act violations, defamation, and other tortious conduct.
  • Successfully opposed transfer of class action lawsuit against pharmacy benefit manager into multi-district litigation.

  • Obtained jury verdict on all claims in three week jury trial for solid waste company accused of trade secret misappropriation.
  • Obtained no damages award in AAA-arbitration seeking $2.5 million from business jet manufacturer.
  • Member of trial team in $50 million, four-week bench trial involving claims of trade secret misappropriation and breach of contract.
  • Defended consulting firm against actuarial malpractice claims brought under False Claims Act; obtained favorable settlement during trial.
  • Represented defense contractor in ERISA class action lawsuit.
  • Represented sovereign government in investor-state treaty arbitration against claims of expropriation of property.
  • Obtained dismissal of lawsuit alleging breach of fiduciary duty and usurpation of corporate opportunity against high level financial services professional.
