Ivy brings a business-focused approach to help clients on complex intellectual property issues and protect their intellectual property rights.

Ivy advises on all aspects of IP, including trademark prosecution and enforcement, patent protection and enforcement strategies, licensing and franchising agreements, domain name disputes, company name disputes, brand protection, anti-counterfeiting, copyright piracy action, and IP litigation assistance in Greater China.  Ivy is also experienced in the protection of confidential information, and advising on data protection and personal data privacy issues.

Prior Experience

Ivy practised IP law as a barrister and solicitor at a full-service international law firm with a prominent IP practice in Ottawa, Canada, where she obtained extensive patent litigation experience and trademark litigation experience.  Ivy has appeared as counsel before the Federal Court in a complex pharmaceutical patent infringement and impeachment trial.  Ivy is experienced with the drug approval process in Canada and proceedings under the Patented Medicine (Notice of Compliance) Regulations.

  • Regularly act for multinational clients in ICANN and CNNIC domain name disputes before the Hong Kong International Arbitration Centre
  • Regularly act for multinational clients in a number of company name complaints and striking off actions against shadow companies in Hong Kong
  • Regularly draft and negotiate IP-related agreements including software license agreements, technology transfer agreements, non-disclosure agreements, trademark license agreements and IP assignment agreements
  • Prepared terms of use and privacy policies for various websites and mobile applications
  • Advised a Fortune 500 company on data protection and personal data privacy issues in relation to its employees
  • Represented the world’s largest integrated non-profit medical group in trademark and copyright infringement cases; counseled them on trademark licensing issues
  • Advised a U.S. manufacturer of personal and oral health care products on packaging and labelling issues in China; acted for them in various domain name disputes before the Hong Kong International Arbitration Centre; counseled them on trademark prosecution issues 
  • Represented the world’s largest travel luggage company in a civil action in Hong Kong in a copyright infringement suit
  • Advised a U.S. food manufacturer on food labeling requirement in Hong Kong
  • Advised a U.S. biotechnology company on pharmaceutical product registration and advertising matters in Hong Kong
  • Advised one of the largest conglomerate and Fortune 500 company on trademark infringement and passing off issues in Hong Kong and China; regularly act for them in a number of company name disputes
  • Counselled a high end lifestyle Chinese restaurant chain based in Hong Kong with respect to its global franchising activities, including preparing franchise agreements, trademark license agreements and consulting agreements, and managing its IP portfolio
  • Regularly perform IP due diligence for the investment and acquisition of companies, including a private equity fund’s investment in mobile app and advising them on IP issues in the ensuing acquisition
