FORREST HELPS CLIENTS WIN INTELLECTUAL PROPERTY DISPUTES AND HELPS CLIENTS NAVIGATE FEDERAL INDIAN LAW.

A partner in Dorsey’s Intellectual Property Litigation Group, Forrest has experience with patent, trade secrets, and other intellectual property litigation. His experience spans a variety of technologies, including: software, cloud computing, medical devices, mining processes, and consumer goods, among other things. His experience includes briefing and arguing motions, managing large scale documents productions, taking and defending depositions (including expert depositions). In addition to intellectual property matters, Forrest is experienced and knowledgeable on class action disputes and Employee Retirement Income Security Act (ERISA) litigation.

Forrest also enjoys a robust practice in the area of federal Indian law. Forrest provides litigation and transactional advice to both Indian tribes and companies doing business in Indian Country. He is an enrolled member of the Comanche Nation of Oklahoma.

Intellectual Property Litigation Experience

  • Counsel for plaintiff asserting Walker Process claims related to oil refining technology
  • Assisted Defendant in claims asserted by non-practicing entity related to cloud computing.
  • Assisted in drafting oppositions to a Daubert motion and motion for summary judgment on behalf of OptumInsight in a software patent case
  • Assisted Vascular Solutions, Inc. with several matters related to patents for medical devices or methods for using medical devices
  • In addition to patent litigation, extensive experience with Lanham Act and trade secrets claims.

Class Action Experience

  • Has represented national bank in several consumer class actions related to mortgage servicing and lender-placed insurance
  • Provided legal research and writing for third-party claims administrator winning dismissal of claims brought on behalf of several putative classes under ERISA and state insurance laws

ERISA Experience

  • Provided legal research and writing for third-party claims administrator winning dismissal of claims brought on behalf of several putative classes under ERISA and state insurance laws
  • Represented employer defending ERISA claims related to residential treatment benefits and assisted with drafting early settlement
  • Obtained dismissal of ERISA breach of fiduciary duty claim in Patricia J. Humphrey v. United of Omaha Life Ins. Co., et al., Civil No. 0:12-cv-02984, 2013 WL 1340778 (D. Minn. Apr. 3, 2013)
  • Represented employer defending ERISA claims for retiree medical benefits and assisted with drafting settlement
  • Represented employer in resolving ERISA pension claims prior to litigation

Representative Federal Indian Law Experience

  • Assisted federally-recognized Indian tribe litigating claims against United States officials under the Indian Self-Determination and Education Assistance Act
  • Provided due diligence services to buyer in $800 million acquisition of an oil and gas company partially owned by a federally-recognized Indian tribe doing business on an Indian reservation
  • Advised federally-recognized Indian tribe on applicability of state tobacco taxes to “native-brand” cigarettes
  • Advised federally-recognized Indian tribe on gaming eligibility of reacquired fee land within its reservation
  • Drafted legal opinion regarding regulatory authority of Indian tribe seeking Treatment as a State status under the Clean Water Act
