Erik regularly represents health care industry clients – including health systems, clinics, physicians and individuals, and insurance companies - with regard to various issues, including credentialing matters (ranging from state licensing Boards to complex federal False Claims Act retaliation litigation), medical malpractice actions, matters involving HIPAA and patient privacy, government investigations (including False Claims Act litigation and investigations), and consumer class actions against payors and providers.
Erik is also an antitrust lawyer, including representing corporate clients in Sherman Act and Clayton Act private litigation and merger/conduct investigations before the Department of Justice and the Federal Trade Commission. He frequently counsels clients on antitrust and competition issues, particularly in matters involving mergers and acquisitions (including Hart-Scott-Rodino reporting and integration issues) and cooperative antitrust exemptions. Erik works closely with Dorsey’s M&A practitioners to shape transaction strategy and structure to avoid and allocate antitrust risk to clients’ benefit.
Erik enjoys a robust national practice in franchise and dealership litigation, ranging from matters before state administrative agencies to substantial appellate work and everything in between, including state court trials. Clients repeatedly seek counsel and advice from Erik regarding franchise and distribution issues in order to shape effective business strategies and avoid litigation. Erik has particularly expertise representing auto manufacturers with regard to dealer network issues across the country.Erik takes a practical, business-minded approach to resolving clients’ legal issues, including significant experience negotiating complex settlements involving ongoing commercial relationships or government demands. But when necessary, Erik guides clients through every step of the litigation process, from pre-litigation assessment to complex e-discovery through trial and appeal.
