Overview

Matt helps debtors and creditors economically resolve financial problems—in court or out of court.

Matt has broad experience representing debtors, creditors, and fiduciaries in complex insolvency matters, in cases involving both individuals and businesses.  Matt’s practice focuses on helping companies navigate a bankruptcy reorganization, from the first day of a case, through confirmation of a plan of reorganization and resolving disputed claims, and to final resolution.  When a bankruptcy case is not appropriate, Matt is able to help with other out-of-court options to resolve a troubled financial situation.

Matt also helps creditors protect their rights in insolvency matters and helps professional fiduciaries discharge their duties and recover the maximum amount for the estates they represent.

  • Represented the assignee of a general assignment for the benefit of creditor in connection with the dissolution of a technology company
  • Represented the assignee of a general assignment for the benefit of creditors in litigation brought by a creditor challenging the disposition of assets
  • Represented a shopping center owner in a successful chapter 11 reorganization resulting in a confirmed plan of reorganization
  • Represented the foreign representatives of a Hong Kong bankruptcy case in a chapter 15 proceeding
  • Represented and indenture trustee in connection with a chapter 11 case filed by a producer of engineered plastic components
  • Prosecuted a nondischargeability suit on behalf of bank against a debtor accused of omitting fraud in inducing the bank to make a loan
  • Represented a medical device company in the collection of past due accounts receivable
  • Defended a former business owner in a fraudulent transfer suit which resulted in an amicable settlement
  • Obtained a reversal of a bankruptcy court decision against an innocent spouse in a dischargeability suit
  • Successfully represented a chapter 7 trustee in recovery of fraudulently transferred assets
  • Represented a bank in a pending diocesan bankruptcy case
