Tim Maloney




For over 40 years Tim has advised clients on all types of large-scale commercial disputes and is the first port of call for key clients facing significant litigation. He helps clients navigate complex crises, nationally and globally.

Tim has extensive and wide-ranging experience litigating in offshore jurisdictions, and many of his cases involve complex cross-border issues and proceedings in multiple jurisdictions. In addition to the UK, Tim’s recent cases have involved litigation in the US, the Caribbean, Bermuda, Switzerland, Russia, Hong Kong, Singapore and China.

Tim also advises extensively on risk management and on tactical issues arising in the context of international litigation, as well as identifying strategies for the mitigation and defence of possible claims.

Representative Litigation

Recent Cases include:

  • Representing a European listed technology company in its capacity as a minority shareholder of a leading UK software company in respect of unfairly prejudicial conduct and bad faith by the majority shareholder, seeking a mandatory injunction, declaratory relief and damages 
  • Representing a listed public company in a £600 million claim for fraudulent misrepresentation and breach of warranty arising out of a Sale & Purchase Agreement following the disposal of a number of its operating subsidiaries
  • Advising a major international upstream oil & gas company in relation to arbitrations concerning Joint Operating Agreements in Asia
  • Representing an international upstream oil & gas company in relation to an arbitration concerning the supply of supply and standby vessels
  • Representing a US investment company in parallel proceedings in the UK High Court and the Delaware Chancery Court
  • Advising a UAE trading company in relation to an ICC arbitration against a French multinational company
  • Successfully representing a leading AIM- listed company and its subsidiaries in their defence of a multi-million dollar derivative lawsuit issued in the Delaware Chancery Court
  • Lead Counsel to a US-listed oil & gas company in successfully obtaining an injunction from the Texas district court against an East European sovereign state in support of an UNCITRAL arbitration
  • Successfully defending a US-listed Fortune 100 company in the defence of a $56m earn-out claim in the UK Commercial Court arising out of the purchase of medical diagnostic technology
  • Advising a major trust company holding multi-billion dollar business assets in relation to invalidity proceedings issued in Bermuda and Switzerland
  • Lead counsel to an multinational offshore shipping company in the obtaining, and successful enforcement in New York and Brazil, of a multi-million dollar judgment in the UK Commercial Court arising out of a subsea cable laying contract
  • Representing a UK public company in the successful prosecution of a UK High Court libel action against a US hedge fund arising out of the publication of a highly defamatory “in depth” report
  • Successfully representing a US client in pursuing UK Commercial Court proceedings arising out of the construction and design of one of Europe’s largest bioethanol plants
  • Representing a consortium of UK and overseas banks in successfully obtaining and enforcing judgment in the Chancery Division of the High Court in respect of claims for fraudulent misrepresentation arising out of a contract to subscribe for shares in a large land development in China
