Sarah Andrews Herman is a member of Dorsey’s Trial and Labor and Employment Practice Groups. Sarah has extensive experience in employment and labor law matters. She frequently handles trial, arbitrations, mediations, EEOC charges, OFCCP audits, wage and hour audits, AAP’s, training of employees and managers, drafting and applying policies and procedures to limit employers’ risk of employment litigation, unionization issues, and collective bargaining. Sarah also has significant litigation experience in a number of areas including employment litigation, commercial litigation and products liability.

Sarah was recognized as Lawyer of the Year 2015 by Best Lawyers in America® for employment law, management and has been named in The Best Lawyers in America every year since 1995. Sarah has also been named to the 2014 Great Plains Super Lawyers list. She has received Chambers USA highest recognition: star ranking since 2003.

Sarah is the partner in charge of the Fargo office of Dorsey & Whitney which was chosen as the “Labor & Employment Law Firm of the Year in North Dakota – 2015” by Global Law Experts.

  • Kowitz v Trinity Health. Won Summary Judgment for client against allegations of disability discrimination and claims of FMLA violation.
  • Holmes v Trinity Health. Won Summary Judgment in age and gender discrimination case; affirmed by Eighth Circuit Court of Appeals.
  • Clausen v National Geographic. Won Summary Judgment defeating allegations of Title IX gender discrimination and retaliation. Judgment affirmed by Eighth Circuit Court of Appeals.
  • North Dakota State Board of Education v Jaeger. Successfully defended Secretary of State Al Jaeger.
  • Jacob and Huck v Nodak Mutual Insurance Company. Won Summary Judgment in age, breach of contract and retaliatory discharge case—affirmed by ND Supreme Court.
  • WFE v Tenneco. Obtained jury verdict for the defense for Agricultural equipment manufacturer in 3 week jury trial in Williston, ND. Jury verdict affirmed by ND Supreme Court.
  • Wenzel v NWPC. Obtained jury verdict for defense defending client on breach of contract and wrongful discharge claims at close of three week trial in Fargo, ND.
