As a leader in the firm’s insurance group, Pat has advised and represented liability, life, health and disability insurers over the past thirty years in prosecution and defense of lawsuits and in responding to regulatory actions and investigations.

For over twenty-five years, Pat has been national coordinating counsel for several defendants in nationwide toxic tort litigation.

Representative Litigation

  • Various v. Nationwide (Employers Insurance of Wausau) – represent liability insurer in large insurance coverage actions typically in the context of underlying toxic tort claims; have obtained favorable summary judgment and allocation rulings and negotiated comprehensive settlements
  • Kramer v. Phoenix Life Ins. Co., 15 N.Y.3d 539 (2010) – represented insurer in cutting edge case on insurable interest questions raised in investor-originated life insurance policies
  • Various v. Guardian Life Ins. Co. – represented insurer in defense of regulatory investigations and lawsuit regarding alleged abandoned property in dormant life insurance policies and annuity contracts
  • Various v. Asbestos Defendants – represent several equipment suppliers and contractors in the supervision and coordination of the defense of asbestos cases in about twenty states
  • Rottenberg v. Phoenix Life Ins. Co. (Sup. Kings Cty, NY) – obtained summary judgment that policyholder’s challenge to a lapse of a life insurance policy is barred by statute of limitations
  • Phoenix Life Ins. Co. v. The Antonio Adam ILIT (Sup. NY Cty, NY) – obtained ruling of first impression in New York that life insurer rescinding a policy for misrepresentations may be entitled to recover damages from policyholder
  • Various v. Phoenix Life and Affiliated Companies – prosecution of rescission actions and defense of death claims based on misrepresentations, particularly in the context of investor-originated life insurance policies
  • Condos v. Musculosketal Transplant Foundation, 208 F. Supp. 2d 1226 (D. Utah 2002) – obtained summary judgment that allograft tissue is not subject to strict products liability law on behalf of Osteotech, Inc.
  • Rhulen v. Canon U.S.A., Inc. – represented Canon in defeat of a nationwide class action alleging breach of warranty and fraud claims arising out of the acquisition of color copiers
  • Various v. Seneca Nation of Indians – represented the nation in a variety of litigated matters
