On November 17, 2025, the Supreme Court of the United States granted certiorari in one case:

Noem v. Al Otro Lado, No. 25-5: This immigration law case will interpret provisions of the Immigration and Nationality Act, 8 U.S.C. 1101 et seq. (the “Act”) that define the process for seeking asylum in the United States. The question presented is: Whether an individual who is stopped on the Mexican side of the U.S.–Mexico border “arrives in the United States” within the meaning of the Act, which provides that an individual who “arrives in the United States” may apply for asylum and must be inspected by an immigration officer.
