Argued and won two landmark cases in the U.S. Supreme Court
- Aspen Skiing Co. v. Aspen Highlands Skiing Corp., 472 U.S. 585 (1985) affirming a multi-million dollar jury verdict in a monopolization case
- Central Bank of Denver, N.A. v. First Interstate Bank of Denver, N.A., 511 U.S. 164 (1994), holding that there was no implied private right of action for aiding and abetting under Section 10(b) of the Securities Exchange Act of 1934. Hear the argument online.

Intellectual Property Litigation

Acted as trial counsel for Cobe Laboratories, an international medical products company, in several patent infringement cases resulting in millions of dollars of licensing agreements for its technology.
Defended Tenneco in a series of trade secret cases involving geophysical data in both state and federal courts.
Led the defense for Microsoft, in a patent infringement suit involving software and internet services resulting in favorable summary judgment ruling after a Markman hearing. See CIVIX-DDI v. Microsoft Corp., F. Supp. 2d, 2000 WL 64747 (D. Colo., Jan 24, 2000).
Defended Talbots in a copyright infringement action which settled before trial.
Represented WaterPik in a patent infringement case. After winning an initial jurisdictional battle, the case settled.
Defended Coors Brewing Company (now known as Molson Coors Brewing Company) in a trademark infringement. The case settled before trial.
Defended Cleveland Golf in a design patent infringement litigation and obtained dismissal of the case.
Represented US Bank in a case in which several lenders left the bank with customer lists and business plans and were hired by a competitor. The case settled before the preliminary injunction hearing.
Represented a clean water instrumentation division of GE in a patent infringement lawsuit which settled after the Markman hearing.
Defended Land 'O Lakes in a trademark infringement action. The case settled after trial and post trial motions were decided.
Represented Tandberg Data, an international provider of data storage technology, in a patent infringement action. After a favorable ruling on claim interpretation, the case settled. See Tandberg Data Corporation v. Hewlett-Packard Company, D. Colo.

Commercial Litigation

Successfully defended US Bank against conflict-of-interest, fiduciary claims in a four-week federal jury trial involving personal trust investment policies.
Represented the Board of County Commissioners, Eagle County, Colorado and defeated an action to enjoin construction and operation of a new passenger terminal at the Eagle County Airport. See Bd. of County Commissioners, County of Eagle, State of Colorado v. Fixed Base Operators, Inc., 939 P.2d 464 (Colo. App. 1997).
Won a directed verdict in a jury trial for a cellular provider in an alleged tortious interference with contract claim.
Won a bench trial and appeal for Arrowhead at Vail, a resort developer, in claims under a right of first refusal in connection with sale of ski area and accompanying real estate.
Represented a national bank in a series of consumer cases concerning securitization of real estate mortgages. The cases settled before trial.
Successfully represented a fixed base operator at Montrose Regional Airport in state court action over the ability of an off-airport tenant to dispense fuel. The case is on appeal.
Won a bench trial for a tunnel contractor in a significant contract/professional liability litigation.
Represented St. Paul Travelers in litigation concerning the sale of a country club. The case settled before trial.
Represented professionals in alleged disciplinary and malpractice claims.

Antitrust Litigation

Successfully defended a major supermarket chain before a jury and on appeal in a federal predatory pricing action. See Shoppin' Bag of Pueblo, Inc. v. Dillion Companies, Inc., 783 F.2d 159 (10th Cir. 1986).
Represented a national bar review course provider in an attempted monopolization case. After summary judgment was reversed on appeal because of disputed factual issues, the case settled. See Multistate Legal Studies v. Harcourt Brace Publ.¸63 F.3d 1540 (10th Cir. 1995).
Represented Gambro, an international provider of blood components, in a monopolization case against a competitor that was threatening to cut off supplies necessary for its business. After the motion for preliminary injunction was filed, the case settled.

Securities Litigation

Won summary judgment for BI, Inc., a public, technology company, in an investor class action alleging securities' fraud.
Won summary judgment for a national bank accused of participating as indenture trustee in a securities fraud involving securitization of municipal securities in Dawson Ridge Securities Litigation.
Represented Janus, a mutual fund company, in alleged violations of the Investment Company Act of 1940. The case settled prior to trial.
Represented securities brokers in numerous arbitrations involving alleged unsuitable investments.

International Arbitrations and Litigations

Represented a Canadian Mining Company in an action against a Russian Oil Company alleging fraud in a joint venture to mine diamonds in Russia. After winning an initial jurisdictional battle, the case was remanded to trial court and is ongoing. See Archangel Diamond Corp. v. Lukoil, 123 P.3d 1187 (Colo. 2005).
Successfully litigated two international arbitrations on behalf of Coors Brewing Company (now known as Molson Coors Brewing Company).

Class Actions

Obtained a defense verdict in a lender liability class action jury trial against a Colorado bank accused of aiding and abetting a Ponzi Scheme.
Successfully defended US Bank at trial and on appeal by preventing certification of a class action brought for unauthorized faxes under the Telephone Consumer Protection Act. See Livingston, et al., v. U.S. Bank, 58 P.3d 1088 (Colo. App. 2002).
Defending Houghton Mifflin Harcourt, a publisher of educational textbooks, in a federal class action claiming copyright infringement. After a favorable ruling on a motion to dismiss, the case settled.

Creditors' Rights and Bankruptcy

Defended a secured creditor in an adversary proceeding in the Kaiser Steel Bankruptcy and ultimately obtained the turnover of its collateral - an ocean going barge.
Represented GATX Capital Corporation in the Western Pacific Airlines Bankruptcy and litigated the turnover of its leased aircraft.
Defended Fidelity Investments and was appointed class counsel in an defendant class action brought in Bankruptcy Court. After litigating issues on summary judgment, the case was settled with the approval of the Court.

Regulatory

Handled numerous cases before state and federal regulatory agencies involving aviation, energy, health care, insurance, professionals and telecommunications.
