Kirsten Schubert is an associate in the Trial Group in the Minneapolis office of Dorsey & Whitney. She represents a broad array of corporate and individual clients in all aspects of complex commercial litigation and disputes, including ERISA, health, and retirement plan litigation; nationwide class actions; broker-dealer, securities, and financial services litigation and arbitration; shareholder litigation; antitrust investigations and proceedings; and white collar criminal defense. Ms. Schubert also devotes significant time to clients on a pro bono basis, including the defense of death row prisoners.

Representative Experience

  • Discovery Management: Ms. Schubert has significant experience working with clients and internal case teams to manage discovery for various complex litigation matters. Ms. Schubert has managed and advised large teams of associates and contract attorneys through all stages of fact and expert discovery, including initial fact-finding, witness interviews, and document collection; electronic document review and production, with particular focus on achieving efficient, high quality review; creation of privilege logs and other discovery tools, working extensively with sophisticated privilege issues; and depositions.
  • Legal Project Management: Ms. Schubert actively assists in the development and implementation of Legal Project Management processes within the firm, including the Dorsey Dashboard, a client communication tool that provides methods for effectively managing matters to a baseline budget.
  • Department of Justice: Ms. Schubert has represented corporate and individual clients in various criminal investigations involving the Department of Justice, including by the Antitrust Division.
  • FINRA Arbitrations: Ms. Schubert has experience representing clients in matters pending before the Financial Industry Regulatory Authority.
  • Figas v. Wells Fargo & Co., D. Minn.: Represented defendants in an ERISA class action alleging various breaches of fiduciary duty relating to investment options within a 401(k) plan.
  • Northwest Airlines, Inc. v. Phillips, D. Minn.: Represented airline against defendant class of 2,500 airline pilots relating to allegations of discrimination within target benefit plan under ADEA, ERISA, and state laws.
