Eric Lopez Schnabel is a partner in the Financial Restructuring and Bankruptcy group. He regularly represents a variety of constituents, including both public and non-public companies, throughout many stages of work-out, pre-bankruptcy planning and the Chapter 11 reorganization or liquidation process. He is counsel to significant creditors, official committees and lenders in bankruptcies and out-of-court restructurings.

Eric's work in the restructuring field brings an important perspective to his corporate finance clients. Eric represents sellers and buyers of a variety of assets in and outside of bankruptcy, including operating companies, real estate, fixed assets and distressed debt. He also counsels on the structure, negotiation, documentation and closing of a variety of transactions, in distressed and healthy situations, relating to the operational and strategic goals of his business clients.

Representative Work

  • Lead counsel to a Fortune 250 company’s power commodities trading, consumption and supply concerns relating to Calpine Corporation’s $18 billion bankruptcy filing in the Southern District of New York. 
  •  Lead counsel to a Fortune 250 company’s negotiations with a variety of vendors on commercial business transactions, including consignment, product testing and contract manufacturing agreements. 
  • Lead counsel to a Tier 1 and Tier 2 automotive supplier through all aspects of pre-petition restructuring negotiations which led to an eventual bankruptcy filing in the District of Delaware and a successful auction and sale to a financial buyer. 
  • Representation as lead counsel to the Official Committee of Unsecured Creditors of Trend Technologies in its $300 million bankruptcy case that ended in consensual asset sales and a plan of liquidation. 
  • First chair on behalf of the plaintiff in a three-day trial relating to an avoidance action before the United States District Court of Delaware involving almost a dozen witnesses, including two expert witnesses, which resulted in the entry of a $2.6 million judgment for the plaintiff.
