The civil remedy in the Racketeer Influenced and Corrupt Organizations (RICO) statute is not limited to the “archetypal, intimidating mobster.” Attorney Nick Akerman explains how RICO can apply to data thieves in an article for The National Law Journal.

Mr. Akerman’s article, “RICO and Data Thieves,” reviews the elements of a civil RICO action as they apply to data theft and discusses how to frame a successful RICO suit predicated on data theft. He also examines a recent federal district court case, Binary Semantics Ltd. v. Minitab Inc., citing the principal reason for the case dismissing a RICO count based on the theft of trade secret data.
