Employers are facing new liability concerns since the March delivery of the long overdue EEOC final regulations implementing the Americans with Disabilities Act Amendment Act of 2008 ("ADAAA"). The expanded definition of "disability" will likely spur more requests for accommodation and lead to an increase in disability discrimination claims and claims for failure to accommodate disabled employees.
