Ms. Hammerbeck is a litigator in the trial group specializing in complex commercial litigation, with emphasis in the areas of contract disputes, business torts, antitrust, unfair competition, class actions (including wage and hour class actions), labor and employment, and products liability (including Proposition 65). She has represented individual and business clients in federal and state courts, as well as complex international arbitrations. Ms. Hammerbeck is also a member of the antitrust and competition law group and the appellate group.

Representative Litigation
Business Trial
  • Represented corporation and officers in breach of contract and fraud actions in multiple interrelated lawsuits in federal and state court, including five-week jury trial; prepared successful motion in limine capping damages at less than one-tenth of those sought by plaintiff.
Antitrust and Unfair Competition
  • Defended credit reporting agency in lawsuit involving antitrust, unfair competition, and other business tort claims; obtained summary adjudication and/or voluntary dismissal of all claims.
  • Represented rights clearance agency and national consumer products company in disputes over licensing of music, including unfair competition, Lanham Act, and invasion of privacy claims.
International Arbitration
  • Represented investors in real estate venture in several interrelated disputes, including international arbitration, lawsuits in multiple state courts, and related appeals.
Employment Class Action
  • Defended wage and hour class actions, including claims of failure to pay overtime wages, failure to provide meal and rest breaks, and violation of California Business and Professions Code section 17200 et seq.
Appellate
  • Obtained appellate victory in California Court of Appeal in unfair competition and antitrust action.
  • Obtained appellate victory in California Court of Appeal prior to joining Dorsey under supervision of law school professor as part of appellate advocacy clinic.
  • Represented appellants in appeals relating to confirmation of arbitration award in California Court of Appeal.
