Managing employment litigation is always a challenge, particularly when it involves a
current employee! When an employee sues the company, an understanding of the law and the attendant employee relations issues is essential. This is even more critical in litigation involving current employees where there is greater risk of increasing your exposure. This seminar will address some of these challenges and the applicable law, including the following:
- Is "business as usual" still the workplace mantra?
- Is the employee insulated from a performance standpoint because of the pending claim?
- Should you manage access to information?
- How do you effectively protect your company's assets, and what is the current status of the law regulating non-competition and non-solicitation agreements in California?
- What is the current status of whistleblower and retaliation laws in California? What are the employer's obligations?
- What additional challenges and considerations do you have when the employee-litigant is also on a medical leave of absence?
Savvy employers recognize that these issues present novel challenges. Mandana Massoumi and Jessica Linehan will review the current state of the laws surrounding retaliation, provide practical tips on managing the employee-litigant and conclude with a role play which will highlight the issues that employers must keep in mind to minimize legal risk and work towards a productive workplace.
