Courtney is in the Benefits and Compensation practice group. Her practice focuses on health and welfare plans and retirement plans.
Courtney focuses a significant portion of her practice on health and welfare plans, including health plans, flexible benefit plans, wellness programs, disability plans, and MEWAs. She works with employers on issues relating to compliance with ERISA, the Internal Revenue Code, the Patient Protection and Affordable Care Act (PPACA - health care reform), HIPAA, and COBRA. Courtney has worked extensively with employers on a variety of PPACA issues, including mandated coverage for adult children, internal and external claims review procedures, amending cafeteria plans for changes to over-the-counter medication reimbursement requirements, and maintenance of grandfathered plan status.
Courtney also advises clients on issues regarding retirement plans, including 401(k) plans, 403(b) plans, defined benefit pension plans, and ESOPs. Her experience includes drafting and amending plan documents and summary plan descriptions, advice with respect to correcting operational errors of qualified retirement plans (including corrections under the Voluntary Compliance Program (VCP)), maintaining qualified plan status, and submitting plans for a favorable determination letter. Courtney's experience also includes filing submissions under the DOL Delinquent Filer Voluntary Compliance Program (DFVCP), addressing disclosure issues, and assisting employers with benefit claims.
