Marilyn Clark is an associate in the Labor & Employment practice group in Dorsey’s Minneapolis Office. She has been with the firm since 2006, and her practice consists of both litigation and advice services in a wide range of employment matters.
Ms. Clark works with employers to successfully address and resolve discrimination claims, including those based on race, gender, national origin, age, and disability, as well as claims alleging failure to accommodate, retaliation, and sexual harassment. Ms. Clark also is experienced with workers’ compensation and unemployment claims, as well as contract and tort disputes such as breach of contract, breach of fiduciary duty, misappropriation of trade secrets, and defamation claims. She has particular expertise in conducting wage and hour audits, and she has presented and offered numerous training sessions on this topic.
In addition to representing clients in various state and federal courts, Ms. Clark has advocated for individuals and businesses in arbitrations, mediations, and administrative proceedings, including proceedings before the Equal Employment Opportunity Commission (“EEOC”), the Occupational Safety and Health Administration (“OSHA”), the Minnesota Department of Human Rights (“MDHR”), state unemployment law judges, and the unemployment and civil rights divisions of various other states.
Ms. Clark also advises clients on employment contracts, employment policies and practices, employee handbooks, reductions in force, and compensation matters, and she offers day-to-day guidance to employers of all sizes on compliance with various federal, state, and local employment laws.
As a former retail manager, Ms. Clark is particularly qualified to understand the daily challenges that arise in the modern workplace. Ms. Clark is able to offer a broad perspective to her clients, which includes not only the potential legal consequences of employment decisions, but also the practical implications of such decisions.
