"On July 24, 2010 and Sept. 22, 2010, the Commission for Revision of Rules of Professional Conduct (CRRPC) provided the State Board of Governors with its final recommendations on 67 proposed new and amended rules, which were adopted by the Board. The Proposed rules become binding once they are approved by the Supreme Court. If the proposed rules become operative, they could impact duties and obligations of in-house counsel conducting internal investigations. Notably, Proposed Rules 1.6 and 4.2 can impact protections applied to communications with a represented person, waiter of privilege, and undercover investigative techniques."
