In a New York Law Journal article, Dorsey partner Sandra Edelman and Dorsey attorneys Steven Fang and Young Lee consider the application of Title III of the Americans with Disabilities Act ("ADA") to retail Web sites. Recently, the operator of the target.com website was sued on the ground that the site did not sufficiently accommodate the needs of the visually impaired.
Discrimination under the ADA is specifically prohibited in "places of public accommodation." The authors suggest that under current case law, some retail Web sites are potentially within reach of this standard. Notwithstanding what the law may require, they counsel Web site operators to take affirmative steps to make their sites more accessible to everyone, including those who access the Web using assistive software.
